By accessing or using mishrasiddharth.com (the “Site”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, please do not use the Site.
These Terms govern use of the Site itself. They do not govern the delivery of any professional engagement, which is governed by a separate Master Services Agreement (MSA) and Statement of Work (SOW) executed at engagement start.
2. About the Site
This Site is operated by Siddharth Mishra, co-founder of Gigaflop Techlab and DiscoverWebTech, Indore, India. It is a professional portfolio and consulting inquiry platform for data engineering and AI engineering services.
Nothing on this Site constitutes a binding offer of services. All engagements require separate written agreements. Pricing shown on the Site is indicative; final pricing is confirmed in a written proposal following a discovery and audit process.
3. Intellectual Property
All content on this Site — including text, case studies, essays, design, code, graphics, and methodology descriptions — is the intellectual property of Siddharth Mishra and/or Gigaflop Techlab / DiscoverWebTech, unless otherwise stated.

To the maximum extent permitted by applicable law, Siddharth Mishra, Gigaflop Techlab, and DiscoverWebTech shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, errors or omissions in content, or any third-party conduct.
Our aggregate liability for direct damages arising from use of the Site shall not exceed INR 5,000 (or equivalent). This limitation does not apply to liability arising from gross negligence, wilful misconduct, or liability that cannot be excluded by law.

This Site links to third-party services including Cal.com, LinkedIn, and GitHub. These links are provided for convenience. We have no control over third-party sites and are not responsible for their content, privacy practices, or availability. 8. Discovery Calls and Pre-Engagement Communication
Discovery calls booked through this Site are exploratory conversations. They do not constitute a consulting engagement, professional advice, or a binding commitment by either party.
- Information shared during discovery calls is treated as confidential on both sides.
- We reserve the right to decline any engagement without obligation to provide reasons.
- No formal professional advice is given during discovery calls. Advice is only provided under a signed engagement agreement.
- Approximately 30% of discovery calls result in a recommendation not to engage us or not to build the project. Such recommendations are made in good faith and do not constitute grounds for any claim.
9. Professional Engagements
Consulting services are governed exclusively by the written MSA, SOW, NDA, and DPA executed with the client. These Terms do not form part of any client engagement. In the event of any conflict between these Terms and a signed engagement agreement, the signed engagement agreement prevails.
10. Confidentiality of Client Information
We maintain strict confidentiality over client information shared through the Site and in the course of any engagement. Details are not published without express written consent. Case studies on the Site are anonymised. If you believe a case study may identify your organisation without consent, contact us and we will review the concern within 5 business days.
11. Availability and Modifications
We reserve the right to modify, suspend, or discontinue the Site or any part of it at any time without notice. We may also amend these Terms at any time. The current version is always published at this URL with the effective date shown. Continued use of the Site after a change constitutes acceptance of the revised Terms.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of India, including the Information Technology Act, 2000 (as amended) and other applicable Indian statutes.
Any dispute arising from these Terms shall first be referred to good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts in Indore, Madhya Pradesh, India.
For clients in the EU, UK, or other jurisdictions with mandatory consumer protection rights, nothing in these Terms limits rights you hold under applicable local law that cannot be contractually waived.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable, it shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions continue in full force.
14. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Siddharth Mishra regarding use of the Site, superseding any prior understandings in relation to the Site.
